Terms and Conditions Circle K ID
1. Who we are
Alimentation Couche-Tard is a Canadian-based group and a world leader in the convenience store sector. In Europe, Couche-Tard, through its Circle K brand, is a leader in convenience store and road transportation fuel retail in Scandinavia, Ireland and the Baltic countries, with a significant presence in Poland.
It is Circle K AS – an Irish limited liability company, which is the legal entity responsible for Circle K ID, and which is the controller of the personal data being processed in Circle K ID.
2. What we do
Circle K's ambition is to become the world's preferred destination for fuel and convenience. To achieve this we offer our customers extra services, like our loyalty program Circle K Extra, mobile payment features, and others.
Services like this contain and process our customers’ personal data. As we take our customers’ privacy seriously and because we want to do all we reasonably can to protect their data, we have created Circle K ID to handle identity management and personal data for such services.
3. What is Circle K ID
Circle K ID is a service where you, as a customer, will get a user account, where we will collect some basic personal data about you, for instance, your name and contact information (see details below). Circle K ID is the single identity management platform where you, as a customer, can choose what services, like Extra, mobile payment feature, or others, you want to use.
If and when you consent to using a service, Circle K ID will provision that service with the personal data it needs.
4. Who can sign up for Circle K ID
Any private person at least 16 years of age residing in a country that does not have laws making such sign-up or usage illegal can sign up for Circle K ID.
5. What information is processed by Circle K ID
Circle K ID has data about who you are, like your name, age, and contact information, which we use to get in touch with you. We also have some more technical data like an internal used ID number. For a full list of data fields and what they mean, please see our FAQ.
6. Information about Processing of Personal Data
By agreeing to these terms and conditions, you are entering into an agreement with Circle K to create a Circle K ID account. This necessitates and is the legal basis for Circle K to process personal data about you as described in these terms and conditions. You are free to cancel your account at any time. However, if the account is associated with any Circle K services, such services must be terminated in accordance with the relevant terms & conditions, before you can cancel the account.
For each individual service you choose to use, you will be informed specifically what data it processes and asked to consent to this.
7. How does Circle K ID collect data
As a general rule, Circle K collects data about you from you, so you will know what data is collected. In addition, if you were a Circle K Extra customer at the time of the creation of your Circle K ID, we moved some of your personal data from Circle K Extra to Circle K ID. You can always see all the data Circle K ID have about you on the account details page.
8. How does Circle K ID provide other services with your data
If you want to use a service, Circle K ID will present you with a description of that service, what personal data it will collect from Circle K ID, and you can then choose to consent to using it. Circle K ID will keep track of what services you have consented to and what data is being sent to the respective services. You can also use Circle K ID to withdraw your consent and thus cancel a service.
9. Your obligations as a Circle K ID user
By creating a Circle K ID account, you promise to carefully read and follow these terms and conditions. You also promise to provide us with correct and accurate information when registering and to update this information in a timely manner should it change. You promise to keep your password, pin-code and similar information secret and not share it with anyone.
You promise to report to Circle K's customer service of any irregularities you may experience or suspect on your account.
10. Amendment of Terms
Circle K can change these terms and condition at its own discretion, with 30 days’ notice. Notice of such updates will be sent through one of your registered communication channels and will also be posted on Circle K's website. Updated terms and conditions can always be found by logging into Circle K ID.
11. Termination of user IDs
If you fail to abide by these terms and conditions or in any other way willfully attempt to misuse your or any other Circle K ID account, Circle K can revoke your account with immediate effect. Circle K reserves the right to terminate the account of any individual who engages in threatening, fraudulent or other illegal behaviour towards Circle K or its employees.
Circle K shall delete your Circle K ID account in cases if you have not logged in within 6 months and you have no Circle K services associated with Circle K ID account. If you want to continue using Circle K ID services you will have to create a new Circle K ID account again.
12. Closing your Circle K ID
You can choose to close your Circle K ID at any time. By closing your account, your access to Circle K ID together with the services associated with the account will be revoked, and your data shall be anonymised or deleted. However, if the account is associated with any Circle K services that have other terms of cancellation, such services must be terminated in accordance with the relevant terms & conditions before you can close the Circle K ID account. Be advised that in case of cancellation, the services that do not foresee cancellation terms shall also be cancelled.
13. Disclaimer and Limitation of Liability
Circle K is offering you the Circle K ID service free of charge on an as-is basis without any guarantees or warranties.
Circle K can choose to close and/or discontinue the service at any time, if possible, with 30 days notice. Notice will be sent through one of your registered communication channels and will also be posted on Circle K's website.
14. Venue and Choice of Law
Unless your local jurisdiction foresees otherwise, these terms and conditions shall be interpreted according to Ireland law as far as national laws allow. Any dispute related to the Circle K ID program shall be handled by the courts of Ireland, if allowed by applicable law by Dublin City Court.
